Attorneys are expected to file a new motion Tuesday in the Vanderbilt University rape case, asking a judge to set a deadline for the release of transcripts of the jury selection process.

Defense attorneys claim one juror was a past victim of sexual assault but did not admit that during juror screening. The attorneys say had they known, that man would not have been allowed to sit on the jury because of his potential bias. They asked the court reporter for transcripts to verify what was said.

“Because there is no firm date, we may ask the judge if he will set a deadline certainly so that everybody can get an exact idea of what was discussed in the voir dire (jury selection) process,” defense attorney Worrick Robinson told The Tennessean.

Six weeks ago, a jury convicted Cory Batey and Brandon Vandenburg, both 21, on charges including rape. The men were found guilty of raping an unconscious woman in Vandenburg’s dorm room on June 23, 2013. Sentencing is set for April 24.
